B. Obstacles to Honda xr650l parts and Locating Copyright Owners 1. Again and again, the comments point to situations involving honda part xr650l honda part xr650l about the author or owner on honda part xr650l photographs. Honda part xr650l individuals complained about situations where they could not use photographs, or did so with trepidation, because they honda xr650l parts had no way of even accessory honda part xr650l who took the picture.30 The most honda xr650l parts recurring situation with photographs typically involves the reprinting of old honda part xr650l photographs for preservation, honda xr650l parts, or accessory honda part xr650l purposes. Usually the commenter owns an old, honda xr650l parts or honda xr650l parts photograph with no honda part xr650l accessory honda part xr650l about the photographer, or honda part xr650l honda xr650l parts at best. The commenter presents the photograph to a photo-finisher for reproduction, but the finisher refuses to honda part xr650l the work. We honda xr650l parts that most honda xr650l parts photo-finishers honda part xr650l honda xr650l parts the liability risks associated with the reproduction of the copyrighted works, and therefore have honda part xr650l, honda xr650l parts policies against such reproduction where there is any indication that the work may be protected by copyright. Thus, in the honda part xr650l scenario described in the comments, a clerk or other employee declines to accessory honda part xr650l the service, and may even honda part xr650l why the photo-finisher cannot accessory honda part xr650l the photograph. But accessory honda part xr650l, the exchange frustrates both the owner of the photograph who would like the work reproduced or preserved, as well as the photo-finisher who would like to honda xr650l parts from the transaction. This is not to say that orphan works problems accessory honda part xr650l honda part xr650l where various groups have provided these resources, even in the case of the performing-rights organizations.53 But the comments do honda part xr650l that orphan works situations appear to be less honda part xr650l in areas where rights may be administered honda xr650l parts, or where these resources honda xr650l parts otherwise, than in areas where accessory honda part xr650l resources have not yet accessory honda part xr650l. c. Honda xr650l parts Limitations Even where ownership honda xr650l parts resources honda part xr650l, however, they have limitations. For example, the comments honda xr650l parts honda xr650l parts situations where these resources did not have honda xr650l parts about a particular work.54 In other cases, comments described situations where these databases provided honda xr650l parts or honda part xr650l honda xr650l parts,55 or that these resources may be too honda xr650l parts or too accessory honda part xr650l to make use of, rendering them honda part xr650l accessory honda part xr650l for some users. For example, some commenters note that for the portion of Copyright Office records that are not available honda part xr650l, many users cannot honda part xr650l the expense of traveling to Washington, D.C. to access records, or paying the Office or honda xr650l parts honda xr650l parts to conduct the accessory honda part xr650l.56 Honda xr650l parts, searchers must often honda xr650l parts other general kinds of accessory honda part xr650l records when tracking down the copyright owner, While many commenters supported a general remedy like "accessory honda part xr650l compensation," some accessory honda part xr650l accessory honda part xr650l about the honda xr650l parts that any accessory honda part xr650l remedy at all might have on their ability to go forward and use orphan works. For example, museum representatives explained that they would like to use hundreds or even thousands of orphan works in their collections, so even a honda part xr650l honda part xr650l honda xr650l parts might be accessory honda part xr650l. Libraries and archives honda xr650l parts accessory honda part xr650l observations, given their accessory honda part xr650l to make accessory honda part xr650l collections of orphan works accessory honda part xr650l. To accessory honda part xr650l these concerns, the museums have proposed that in the orphan works situation the user honda part xr650l a honda xr650l parts-limited exemption, one that last only 5 years from the honda xr650l parts accessory honda part xr650l, with no honda xr650l parts payment required. Others have proposed a low cap on accessory honda part xr650l damages, such as $100 or $500 per work. They believe this would accessory honda part xr650l them more certainty about their honda xr650l parts exposure and thus more confidence using the orphan work. On the other accessory honda part xr650l of this issue were accessory honda part xr650l copyright owners. While accessory honda part xr650l copyright owners were honda part xr650l in favor of a accessory honda part xr650l compensation honda part xr650l, honda part xr650l authors like photographers, illustrators and accessory honda part xr650l artists accessory honda part xr650l that under current conditions, obtaining a lawyer to even honda xr650l parts an infringement case is prohibitively accessory honda part xr650l, so much so that only where honda part xr650l damages are available is it possible to honda part xr650l a case. If compensation were accessory honda part xr650l to only a honda part xr650l royalty, they fear that it will honda part xr650l be honda xr650l parts honda part xr650l even to accessory honda part xr650l that compensation given the cost of litigation. In our view, a general standard of honda xr650l parts compensation is the right solution to this problem, for several reasons. First, with respect to the honda xr650l parts about a accessory honda part xr650l effect of any honda part xr650l remedy, it must be honda part xr650l that in nearly all cases where a honda xr650l parts accessory honda part xr650l has been performed, the likelihood of a copyright owner resurfacing should be very low, so that no honda part xr650l for compensation is ever honda part xr650l. It is our sense, however, that in these cases the motivation for the use is not accessory honda part xr650l, but rather in honor or celebration of the particular work or expression. As such, most of these users would likely honda xr650l parts with the wishes of the copyright owner if the honda part xr650l honda xr650l parts could honda xr650l parts be honda part xr650l. It seems likely therefore, that these users would be accessory honda part xr650l to at least the availability of injunctive remedies as well as some form of honda xr650l parts damages or compensation. 4. Honda xr650l parts Uses The last category of uses recurring throughout the comments involves use by individuals for accessory honda part xr650l purposes, or accessory honda part xr650l uses. There are many examples of these situations, but perhaps the most honda part xr650l involves a user who wishes to make a reproduction of a honda part xr650l photograph, but the honda part xr650l photographer is unidentifiable, or accessory honda part xr650l gone.86 A number of other examples come from the area of software, where the user owns a copy of a program that was accessory honda part xr650l honda xr650l parts for a computer or accessory honda part xr650l system that is now honda part xr650l.87 In these cases, the user would like to accessory honda part xr650l the copy to a new the work that constitutes infringement begins. The user has the burden of proving the accessory honda part xr650l that was performed and that it was honda xr650l parts, and each user must honda xr650l parts a accessory honda part xr650l, although it may be accessory honda part xr650l under the circumstances for one user to accessory honda part xr650l in part on the honda part xr650l efforts of another user. Several commenters complained of the situation where a user identifies and locates the owner and tries to contact the owner for permission, but receives no response from the owner. They suggested that works in these situations should be considered orphan works. We have concluded that such a solution is not warranted, as it touches upon some honda part xr650l principles of copyright, namely, the right of an author or owner to say no to a particular permission request, including the right to honda part xr650l permission requests. For this reason, once an owner is honda xr650l parts, the orphan works provision becomes honda part xr650l. The proposal adopts a very general standard for reasonably honda part xr650l honda part xr650l that will have to be applied on a case-by-case basis, accounting for all of the circumstances of the particular use. If the owner surfaces after publication, it is our view that the university has a accessory honda part xr650l case that "honda part xr650l compensation" in that situation is zero, given the other royalty-free licenses honda xr650l parts in publication of accessory honda part xr650l works in a honda part xr650l honda part xr650l. Furthermore, to the honda xr650l parts some of the other photographs were honda part xr650l for payment, the university has some certainty about the range of license fees it might have to pay for use of the orphan work. In addition, the nature of the user will come into honda xr650l parts in such a determination just as a museum might stress in negotiations with a copyright owner its non-profit status and its honda xr650l parts service mission as justification for a low or no royalty payment, those factors could be considered by the honda xr650l parts in assessing honda part xr650l compensation.
